Terms of Service for myPick Platform

1. These Terms of Service, hereinafter referred to as the "Terms," define the rules and conditions for using the myPick Platform, hereinafter referred to as the "myPick Platform." Words used in capital letters have the meanings assigned to them in the Terms.
2. The myPick Platform is intended for Users and Subscribers who have carefully read the content of the Terms, intend to comply with them, and are able to use the myPick Platform.


GLOSSARY
**User**
- a natural person who has full legal capacity, uses the myPick Platform after registration, has familiarized themselves with the current content of the Terms, accepted its current wording, committed to complying with the Terms, and has the Technical Requirements to use the myPick Platform. Users are not authorized without the consent of the myPick Platform, particularly to copy in whole or in part materials, content, myPick Platform presentations, or distribute them. Natural persons lacking full legal capacity, excluding those under 13 years of age, are obliged to carry out all activities with the consent of their legal representatives or guardians.

**Technical Requirements** - Users wishing to use the myPick Platform should have a computer with internet access, equipped with a web browser and antivirus software, or a portable device (phone, tablet) with iOS or Android system.

**Registration** - entering data specified by the myPick service by the User into the myPick Platform according to the Terms.

**Subscriber** - a natural person with full legal capacity, a legal entity, or an unincorporated organizational unit without legal personality who purchased a work or subscribed to the myPick Platform, uses the myPick Platform according to the Terms, has familiarized themselves with and accepted the current content of the Terms, and has the Technical Requirements to use the myPick Platform. Subscribers are not authorized without the consent of the myPick Platform, particularly to copy in whole or in part materials, content, myPick Platform presentations, or distribute them. Natural persons lacking full legal capacity, excluding those under 13 years of age, are obliged to carry out all activities with the consent of their legal representatives or guardians.

**Subscription** - a fee for obtaining access to the myPick Platform in the version indicated on the myPick Platform.

**Price List** - contains current prices for using the myPick Platform.

USAGE OF THE SERVICE

Registration is done by consenting to the use of Google or Facebook accounts for logging into the myPick SERVICE, or by completing the Form available on the website http://myPick.pl/signup with the following data:
- email address;
- password;
- phone number;
- address;
- location details for pickup;
- company information.

I.
The Form should be filled in all fields indicated for completion and contain all User statements by crossing/checking the appropriate field for each statement.

II.
Before each login to the myPick Platform, the User is asked to familiarize themselves with the current content of the Terms and to accept them and submit a statement of familiarity with the current content of the Terms. If the User does not agree with any provision of the Terms, they are asked not to log into the myPick Platform and not to use the myPick SERVICE.

III.
The myPick SERVICE was created by Michał Dzierwa Doradztwo Gospodarcze, Opolska 10/103, 40-084 Katowice, NIP: 6322019273, which is also the provider of access to works in the myPick SERVICE, available on the myPick.pl website.

IV.
User personal data will be used in accordance with the Personal Data Protection Act of August 29, 1997. The Administrator of Users' personal data is Michał Dzierwa Doradztwo Gospodarcze, Opolska 10/103, 40-084 Katowice, NIP: 6322019273. By registering in the myPick SERVICE, the User agrees to the collection and processing of their personal data by the myPick SERVICE for the purpose of executing the provisions of the Terms and using the myPick Platform. The User acknowledges that they have the right to access the content of their data and to correct, delete, or object to them under the terms specified in the Personal Data Protection Act. Providing data is voluntary.

V.
The current content of the Terms is available on the myPick.pl/regulamin website along with all changes marked with the date and time of their introduction.
VI.
After successful login, a contract will be concluded between the Subscriber and the myPick SERVICE, from which the Subscriber may withdraw within 14 days from the first login date, after completing the withdrawal form available on the SERVICE. The right of withdrawal does not apply to the User, Subscriber who has used the myPick Platform service(s).

VII.
A Subscriber who has purchased a renewable subscription to access content on the myPick SERVICE may cancel it by:I. Canceling the subscription in the Google Store by making appropriate changes in the "Manage Subscriptions" section of the GooglePlay Store application in the context of the myPick application.II. Following the instructions sent by Apple if the subscription was made on an iOS device.

VIII.
The myPick SERVICE may terminate the agreement with the User or Subscriber with a 14-day notice for valid reasons.

IX.
Users, Subscribers are responsible for the content of data, information provided to the myPick Platform, especially during Registration. The myPick SERVICE has the right to block access to the myPick Platform for a User or Subscriber who:Uses the content of the myPick Platform for purposes incompatible with its purpose or to the detriment of third parties;Violates the law or provisions of these Terms.

X.
The myPick SERVICE will exercise due diligence to ensure that the use of the Services on the Platform in accordance with the Terms and meeting all requirements specified on the myPick.pl website is correct.

XI.
Users, Subscribers consent to and acknowledge that any attempts, especially hacking into the myPick Platform or unlawful use of content or works posted on the myPick SERVICE, including functionalities or any copyright infringement, such as copying data or sharing any myPick Platform content outside the service, are prohibited and considered as usage contrary to the Terms, which may result in irreversible blocking of access to the Service and taking appropriate legal action.

XII.
The right to file a complaint belongs to Users or Subscribers. The complaint should include the name, surname, or name of the legal person or unincorporated organizational unit without legal personality, the exact address, as well as a precise description and indication of the reason for the complaint. Complaints can be sent electronically to the address contact@myPick.pl or in writing to the address 40-084 Katowice, Opolska 10/103. Complaints are considered by the myPick SERVICE within 14 days from the date of receipt. The User or Subscriber will be informed by the myPick SERVICE by registered mail to the address provided in the complaint within 14 days from the date of consideration of the complaint. The Participant has the right to appeal to the common court.

XIII.
Any disputes arising from the application of the Terms will be resolved by the competent common court. Polish law applies.

XIV.
In case of finding the nullity of any provision of the Terms based on a valid court decision, the remaining provisions remain binding for Users, Subscribers, the myPick Platform.

Prices for using the myPick Platform depend on the selected payment channel, subscription period, and type of subscription. All prices include VAT:

b) Monthly subscription payment by transfer, Basic package - 299 PLN
c) Monthly subscription payment by transfer, Professional package - 599 PLN
